West Virginia to Appeal Transgender Athlete Ruling to Supreme Court
West Virginia Attorney General Patrick Morrisey announced on Wednesday that the state will appeal to the U.S. Supreme Court regarding a recent ruling by the 4th U.S. Circuit Court of Appeals that allowed a transgender athlete to compete on Bridgeport Middle School’s sports teams. The ruling stated that West Virginia’s transgender sports ban violated the rights of 13-year-old Becky Pepper Jackson under Title IX, the federal civil rights law that prohibits sex-based discrimination in schools.
Jackson, who has been taking puberty-blocking medication and publicly identified as a girl since the third grade, has been at the center of a legal battle between the state and LGBTQ advocacy groups. The appeals court sided with Jackson and the ACLU, Lambda Legal, and other groups who sued the state after Governor Jim Justice signed the ban into law.
Following the ruling, Jackson went on to win the shot put and finish second in the discus at a middle school championship meet, where five competitors from a rival school refused to compete against her. The incident sparked controversy and led to a standing ovation for Jackson and the other female athletes at a news conference held by Morrisey.
While Morrisey argued that the state’s law is reasonable and necessary to protect the integrity of women’s sports, LGBTQ advocates like Fairness West Virginia Communications Director Jack Jarvis emphasized the importance of supporting all women, including transgender women like Jackson.
The case highlights the ongoing debate over transgender rights in sports and the broader issue of gender identity in public life.
